Loyalty
The real estate broker must act in the best interest of the buyer at all times.

Disclosure of Known Material Facts
Some examples include these items below, but are not limited to:

  • Relationships between broker and any other parties.
  • The existence of other offers on the same property.
  • Status of earnest money at all times.
  • A best estimate as to a property’s market value.
  • Existence of a defined commission split with other brokers.
  • Any known property defects with respects the buyer’s prospective purchase.

Confidentiality
Any and all discussions, facts or other information which should not be disclosed to other brokers and / or sellers are always to be kept strictly confidential between a buyer’s broker and the buyer. This includes knowledge of a purchaser’s willingness to pay a higher price or accept terms other than those being made in the offer. A broker has the responsibility of fair and honest dealings with all parties to the transaction.

Accurate Accounting
Accurate and timely accounting for all monies or property received by the Broker as respect to the transaction. The Buyer has a right to ask and receive at any time this full accounting.

Negotiating Skills and Care
The broker or associate broker provides information for the buyer to arrive at an acceptable purchase price and terms. As a buyer’s broker, your BuyRuidoso.com LLC broker will represent you and your interests alone in the purchase of your property. 

Commissions
Typically, your BuyRuidoso.com LLC Buyer’s Broker will receive commission for representing you from the property seller. This is the most common of arrangements with the seller signing a listing agreement with their broker which will specify a fee to be paid to their broker as well as the Buyer’s Broker.

Less common is where the property buyer pays his or her broker a commission as set out in their written Buyer’s Broker Agreement. With the existence of a written Buyer’s Broker Agreement it is more common that the buyer’s broker commission will be paid by the seller when the seller has agreed to compensate a buyer’s broker, or by the buyer if the buyer purchases a property in which the seller is not offering to compensate a Buyer’s Broker.
